The Secretary of State, in exercise of the powers conferred on him by sections 6(3) and 15(6) and (7) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and extent

1.  These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Competition and Specified Periods) (Scotland) Amendment Regulations 1991, shall come into force on 4th December 1991 and shall apply to Scotland only.

Amendment

2.  Regulation 3(2) of the Local Government Act 1988 (Defined Activities) (Competition and Specified Periods) (Scotland) Regulations 1990(2) shall be amended by substituting for the definition of “EW” the following:–

Explanatory Note

(This note is not part of the Regulations)

Regulation 3 of the Local Government Act 1988 (Defined Activities) (Competition and Specified Periods) (Scotland) Regulations 1990 provides that section 6 of the Local Government Act 1988 (restrictions on carrying out functional work) shall apply where certain authorities propose to carry out the activity of managing sports and leisure facilities on or after specified dates. In the period beginning on 1st January 1992 and ending on 31st July 1992, and the period beginning on 1st August 1992 and ending on 31st December 1992, that section applies to “the regulated proportion” of specified work, which quoted expression is defined as work to the value of the product of the formula set out in regulation 3(2) of those Regulations.

These Regulations amend one of the factors of the formula set out in that regulation.
