This Order revokes the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No. 7) Order 1991 (“No. 7 Order”) and the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No. 10) Order 1991 (“No. 10 Order”) which imposed prohibitions on the fishing for or taking of (article 4), the movement of (article 5) and the landing of or use in the production of food (article 6) of bivalve molluscs within the area designated in the Schedule respective to each Order. These areas are–
(a)the area of the sea surrounding the North Isles of Orkney apart from the areas of sea surrounding North Ronaldsay, the northern part of the Island of Sanday and the western part of the Island Rousay (No. 7 Order); and
(b)the area of sea within Scapa Flow (No. 10 Order).
The effect of this Order is to remove completely the prohibition on fishing for, or taking of, landing of, or the use in food production of, bivalve molluscs from those areas.
