Explanatory Note

(This note is not part of the Order)

This Order provides for the allocation of certain proceedings concerning children between the High Court, the county courts and the magistrates' courts.

Article 3 prescribes certain proceedings which must be commenced in a magistrates' court.

Article 4 prescribes the court in which are to be brought applications to vary, extend or discharge orders.

Articles 5 to 13 regulate transfer between different courts and categories of court.

Articles 14 to 20, and Schedules 1 and 2, deal with the distribution of business amongst the county courts, and provide for the Principal Registry of the Family Division to be treated as a county court.
