The Explosives Act 1875 shall except insofar as it applies to Northern Ireland be modified as follows–
(a)in section 5 for proviso (1) substitute the following proviso–
“(1) To a person keeping gunpowder for his private use (within the meaning of the Control of Explosives Regulations 1991); or”;
(b)in section 40(4) delete the words “for private use and not for sale, or”;
(c)for section 41 substitute the following section–
“41. Exception of safety cartridges
Nothing in this Act shall apply to the filling or conveying for private use and not for sale of any safety cartridges to the amount allowed by the Control of Explosives Regulations 1991 to be kept for private use within the meaning of those Regulations.”;
(d)in section 50 delete from the first paragraph the words “percussion caps, or safety fuzes for blasting, or”.
