The A406 London North Circular Trunk Road (Improvement between Silver Street and Hall Lane Trunk Roads, Slip Roads and Bridge) Order 1991

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10, 41 and 106 of the Highways Act 1980(1), and now vested to him(2), and of all other enabling powers:

1.  The new highways which the Secretary of State proposes to construct–

(a)along the routes described in Schedules 1, 2 and 3 to this Order (the highways along each of these routes being in this Order referred to as “the main new trunk road”); and

(b)along the routes described in Schedules 1, 2 and 3 to this Order which connect the trunk road and the main new trunk roads with other highways at the places stated in those Schedules (the highways along these routes being in this Order referred to as “the trunk road slip roads”),

shall become trunk roads as from the date when this Order comes into force.

2.  The centre line of each of the new trunk roads is indicated by a heavy black line on the deposited plan.

3.  The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunk roads that–

(a)where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority; and

(b)where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purposes of through traffic.

4.  The Secretary of State is hereby authorised to construct as part of the main new trunk road referred to in Schedule 3 hereto and as part of the trunk road slip roads also referred to in that Schedule and numbered 12 and 13 on the deposited plan, that part of the bridge specified in Schedule 4 hereto which will carry part of those roads over the River Lee Navigation.

5.  In this Order–

(1) All measurements of distance are measured along the route of the relevant highway:

(2) (i) “the deposited plan” means the plans in the plan folio numbered LRO 64/19/2/02 and marked “The A406 London North Circular Trunk Road (Improvement between Silver Street and Hall Lane Trunk Roads, Slip Roads and Bridge) Order 1991”, signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

(ii)“the new trunk roads” means the main new trunk roads and the trunk roads slip roads and “a new trunk road” means one of those highways; and

(iii)“the trunk road” means the A406 London North Circular Trunk Road.

6.  This Order shall come into force on 11th July 1991 and may be cited as the A406 London North Circular Trunk Road (Improvement between Silver Street and Hall Lane Trunk Roads, Slip Roads and Bridge) Order 1991.

SCHEDULE 1

ROUTE OF THE MAIN NEW TRUNK ROAD

The route of the main new trunk road, given the reference number 1 on the deposited plan, is a route at Upper Edmonton in the London Borough of Enfield, approximately 0.44 kilometres in length, starting 35 metres west of a point on the trunk road opposite the north western corner of61 Sterling Way, then going generally eastwards and ending at a point on the trunk road 33 metres east of the north eastern kerbline of Cross Street.

ROUTES OF THE TRUNK ROAD SLIP ROADS

(a)

a route, given the reference number 4 on the deposited plan, to connect Lower Fore Street with the eastbound carriageway of the trunk road.

(b)

a route, given the reference number 5 on the deposited plan, to connect the westbound carriageway of the trunk road with Upper Fore Street.

SCHEDULE 2

ROUTE OF THE MAIN NEW TRUNK ROAD

The route of the main new trunk road given the reference number 6 on the deposited plan, is a route at Upper Edmonton in the London Borough of Enfield, approximately 0.65 kilometres in length, starting 2 metres east of a point on the trunk road opposite the north-eastern corner ofNo. 116 Angel Roadand going generally eastwardsand then south-eastwardsand ending at a point on the trunk road approximately 115 metres east of the subway under the trunk road near Angel Road Station.

ROUTES OF THE TRUNK ROAD SLIP ROADS

(a)

a route, given the reference number 7 on the deposited plan, to connect the eastbound carriageway of the trunk road with the trunk road slip road numbered 8 on the deposited plan, and referred to at item (b) of this Schedule.

(b)

a route, given the reference number 8 on the deposited plan, to connect Montagu Road, and the trunk road slip roads numbered 7 and 10 on the deposited plan and referred to at items (a) and (d) of this Schedule, with the westbound carriageway of the trunk road.

(c)

a route, given the reference number 9 on the deposited plan, to connect the westbound carriageway of the main new trunk road, referred to in this Schedule, with the trunk road slip road numbered 8 on the deposited plan and referred to at item (b) of this Schedule.

(d)

a route, given the reference number 10 on the deposited plan, to connect Montagu Road and the trunk road slip road numbered 8 on the deposited plan and referred to at item (b) of this Schedule with the eastbound carriageway of the main new trunk road referred to in this Schedule.

SCHEDULE 3

ROUTE OF THE MAIN NEW TRUNK ROAD

The route of the main new trunk road, given the reference number 11 on the deposited plan, is a route at Upper Edmonton in the London Borough of Enfield approximately 0.59 kilometres in length, starting 20 metres south-west of a point on the trunk road opposite the north-western corner of 282 Angel Road, then going generally north-eastwardsand then eastwards and ending at a point on the trunk road 132 metres west of the south-western kerbline of Hall Lane at Chingford, in the London Borough of Waltham Forest.

ROUTES OF THE TRUNK ROAD SLIP ROADS

(a)

three routes, given the reference numbers 12, 13 and 14 on the deposited plan, to connect the eastbound carriageway and the westbound carriageway of the main new trunk road with a roundabout to be constructed under the main new trunk road in the vicinity of the junction of Harbet Road and Lower Hall Lane.

(b)

a route, given the reference number 15 on the deposited plan, to connect a new local highway with the eastbound carriageway of the trunk road.

(c)

two routes, given the reference numbers 16 and 17 on the deposited plan, to connect the westbound carriageway of the trunk road with a roundabout to be constructed in the vicinity of Folly Lane and the trunk road.

SCHEDULE 4REFERENCE AND SPECIFICATIONS OF THE PROPOSED ROAD BRIDGEOVER THE RIVER LEE NAVIGATION IN THE VICINITY OF THE TRUNKROAD IN THE LONDON BOROUGH OF ENFIELD

SPECIFICATION

POINTS OF COMMENCEMENT AND TERMINATION

From a point on the south side of the River Lee Navigation 24 metres south of the existing bridge carrying the trunk road over the river to a point on the north side of the River Lee Navigation approximately 48 metres north of the existing bridge carrying the trunk road over the river.

SPAN

Part of one span of 25 metres measured square to the river.

HEADROOM

Not less than 3 metres above normal water level which is 10.05 metres above Ordnance Datum Newlyn to be maintained for the full width of the proposed bridge.

WATERWAY

The existing 11.5m navigational channel to be maintained.
