The Minister of Agriculture, Fisheries and Food in relation to England, and any marine waters adjacent to England, the Secretary of State for Scotland in relation to Scotland (including the marine waters thereof) and the Secretary of State for Wales in relation to Wales, and any marine waters adjacent to Wales, in exercise of the powers conferred on them by section 13(1) of the Diseases of Fish Act 1937(1), and of all other powers enabling them in that behalf, hereby make the following Order:–

Title and commencement

1.  This Order may be cited as the Diseases of Fish (Amendment of Definition of “Infected”) Order 1990 and shall come into force on 12th April 1990.

Amendment of definition of “infected” in Diseases of Fish Act 1937

2.  In the definition of “infected” in section 10(1) of the Diseases of Fish Act 1937(2), after the words “infectious pancreatic necrosis (IPN)”, there shall be inserted the words “infectious salmon anaemia (ISA)”.

In witness whereof the Official Seal of the Minister of Agriculture, Fisheries and Food is hereunto affixed on 5th March 1990.

Explanatory Note

(This note is not part of the Order)

This Order amends the list of diseases to which the provisions of the Diseases of Fish Act 1937, as amended, apply.

The Order amends the definition of “infected” in section 10(1) of the Act by adding infectious salmon anaemia to the list of diseases in that section (article 2).

1937 c. 33; the definition of “the Minister” in section 10(1) was inserted by section 5 of, and the Schedule, paragraph 8 to, the Diseases of Fish Act 1983 (c. 30). A new section 13 was substituted by section 4(6) of the Diseases of Fish Act 1983.

The definition of “infected” in section 10(1) was amended by the Diseases of Fish (Definition of “Infected”) Order 1984 (S.I. 1984/301) and the Diseases of Fish (Definition of “Infected”) Order 1988 (S.I. 1988/195), and in relation to Scotland only, by the Diseases of Fish (Definition of “Infected”) (Scotland) Order 1986 (S.I. 1986/213).
