The Insolvency Fees (Amendment) Order 1990

Coming into force

The Lord Chancellor, in exercise of the powers conferred on him by sections 414 and 415 of the Insolvency Act 19861, and with the sanction of the Treasury, hereby makes the following Order:–

This Order may be cited as the Insolvency Fees (Amendment) Order 1990 and shall come into force on 2nd April 1990.

The Insolvency Fees Order 19862 shall be amended–

a

in Article 9–

i

by substituting for the amount “£200” shown in relation to a winding-up petition to be presented under the Act, the amount “£240”;

ii

by substituting for the amount “£100” shown in relation to a bankruptcy petition to be presented under section 264(1)(b), the amount “£120”; and

iii

by substituting for the amount “£200” shown in relation to a bankruptcy petition to be presented under section 264(1)(a), (c) or (d), the amount “£240”; and

b

in the Schedule by substituting for the amount “£17.40” shown in relation to Fee No. 7 in Part I and Fee No. 10 in Part II, in each case, the amount “£17.83”.

This Order amends the Insolvency Fees Order 1986 (S.I.1986/2030), which applies to insolvency proceedings commenced on or after 29th December 1986. It increases with effect from 2nd April 1990 the deposits payable on the presentation of a bankruptcy or winding-up petition. The deposit is to be £240 in all cases except where the debtor presents his own bankruptcy petition, in which case it is to be £120. It also increases to £17.83, with effect from 2nd April 1990, Fee No. 7 in Part I and Fee No. 10 in Part II of the 1986 Order, being the fee to be charged on the insertion in the London Gazette by the Secretary of State or the official receiver of any notice authorised by the Insolvency Act 1986 or Insolvency Rules 1986 (S.I.1986/1925).
