SALMON AND FRESHWATER FISHERIES

The Secretary of State, having received complaints concerning the implementation of proposals and having come to such opinion on these complaints as he may, under section 1(7) of the Freshwater and Salmon Fisheries (Scotland) Act 1976(1), come to, in exercise of the powers conferred upon him by that section and of all other powers enabling him in that behalf, hereby makes the following renewal Order:
1. This Order may be cited as the River Tay Catchment Area Protection (Renewal) Order 1990 and shall come into force on 30th January 1990.
2. In this Order “the 1986 Order” means the River Tay Catchment Area Protection Order 1986(2).
3. The 1986 Order is hereby renewed.
4. During the period from 30th January 1990 to 29th January 1993, both dates inclusive, fishing for or taking freshwater fish in the inland waters in the area prescribed in article 4 of the 1986 Order, without legal right or without written permission from a person having such a right, is hereby prohibited.

This Order renews the River Tay Catchment Area Protection Order 1986 which prohibited fishing for or taking freshwater fish in inland waters in the area prescribed in that Order without legal right or without written permission from someone having such a right. The effect of the renewal is that the prohibition applies during the period from 30th January 1990 to 29th January 1993.
The prescribed area is the whole of the catchment area of the River Tay which lies within Tayside and Central Regions upstream of its confluence with, and including the catchment area of, the Annaty Burn, but excluding the catchment areas of the rivers Tummel and Isla. The area is defined by reference to a detailed large scale map which may be inspected at the office of the Department of Agriculture and Fisheries for Scotland, Pentland House, Robb’s Loan, Edinburgh on any working day between 8.30 a.m. and 4.30 p.m.
The map annexed to and forming part of this note gives a general guide to the boundaries of the prescribed area.
