The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1) and of all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (England) Order 1990 and shall come into force on 26th March 1990.
2. Catering carried out by the Wrekin District Council at premises known as Barclay Lodge, situated at Wellington Road, Dorrington, Telford, Shropshire, shall not be treated as a defined activity within the meaning of section 2(2)(e) of the Local Government Act 1988 so long as those premises are used wholly or partly as housing accommodation for elderly or infirm persons who need assistance with eating or who need special diets.

This Order has the effect of not requiring the Wrekin District Council to put out to competitive tendering catering at Barclay Lodge so long as it is used, wholly or partly, as housing accommodation for elderly or infirm persons who need assistance with eating or who need special diets.
