The Secretary of State for Education and Science, in exercise of the powers conferred on him by sections 168 and 231 of the Education Reform Act 1988(1) hereby makes the following Order:
1. This Order may be cited as the Education (Inner London Education Authority) (Property Transfer) (Amendment) Order 1990 and shall come into force–
for the purposes of article 2(c), on 27th February 1990;
and for the purposes of article 2(a) and (b) on 1st April 1990.
2. The Education (Inner London Education Authority) (Property Transfer) Order 1990(2) is amended–
(a)by the substitution for paragraph (2) of article 3 of the following paragraph:
“(2) Paragraph (1) does not apply to land–
(a)held for investment;
(b)which is the subject of any agreement for disposal by ILEA, or of a resolution by ILEA or any committee or sub-committee of ILEA to the effect that the land is surplus to ILEA’s requirements and should be disposed of; or
(c)which is specified in any schedule to this Order.”;
(b)by the deletion, in paragraph (2) of article 5, of the words “, subject to paragraph (3),”; and
(c)by the substitution, in paragraph (2) of article 11, of the date “15th March 1990” for the date “27th February 1990”.

This Order corrects a defect in article 11 of the Education (Inner London Education Authority) (Property Transfer) Order 1990 (S.I. 1990/124). The powers conferred on the London Residuary Body by the article as originally drafted are incapable of exercise since the article only comes into force on the date (27th February 1990) by which the powers purportedly have to be exercised. The amendment permits the exercise of the powers before 15th March.
The opportunity has also been taken to make two drafting amendments of a clarifying nature to articles 3(2) and 5(2) respectively. 50p net
