The Secretary of State for Transport makes this Instrument in exercise of powers conferred by sections 16 and 17 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1.  The Hampshire (Minley Interchange) (M3) Motorway Scheme 1989 is hereby confirmed with modifications.

2.  The said Scheme as confirmed (hereinafter referred to as “the Scheme”) is set out in the Schedule hereto and copies of the Scheme with its accompanying plan are deposited at the offices of the Department of Transport, 43 Marsham Street, London SW1 3PY and at the offices of the County Council of Hampshire at the County Secretary’s Department, The Castle, Winchester, Hampshire.

3.  The Scheme will come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

4.  This Instrument may be cited as the Hampshire (Minley Interchange) (M3) Motorway Scheme 1989 Confirmation Instrument 1990.

THE SCHEDULETHE HAMPSHIRE (MINLEY INTERCHANGE) (M3) MOTORWAY SCHEME 1989

The Hampshire County Council make this Scheme in exercise of their powers under sections 16 and 17 of the Highways Act 1980 and of all other enabling powers:

1.  The Council are authorised to provide for the use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Highways Act 1980—

  • special roads along the routes described in the Schedule to this Scheme for the purpose of connecting the London—Winchester Motorway (M3) with other highways at the places stated in that Schedule (these special roads being in this Scheme referred to as “the Connecting Roads”).

2.  The centre lines of the Connecting Roads are indicated by heavy black lines on the deposited plan.

3.  In this Scheme—

“the Council”means the Hampshire County Council;
“the deposited plan”means the plan numbered M3/17.B marked The Hampshire (Minley Interchange) (M3) Motorway Scheme 1989, sealed with the Common Seal of the Council and deposited at the offices of the Council at the County Secretary’s Department, the Castle, Winchester, Hampshire;
“the Motorway” and “the Connecting Roads”have the meanings given in Article 1 of this scheme;
“the classified road”means the highway which the Council propose to construct from a point on the unclassified road (which is proposed to be classified A327) 190 metres east of its junction with Bramshott Lane north eastwards and northwards for a distance of 1.5 kilometres to a point on C4 Minley Road (which is proposed to be classified A327) 370 metres north west of its junction with Sandy Lane all in the District of Hart in the County of Hampshire.

4.  This Scheme may be cited as The Hampshire (Minley Interchange) (M3) Motorway Scheme 1989.

SCHEDULEROUTES OF THE CONNECTING ROADS

Junction with the M3 Motorway at Cove in the County of Hampshire

Four routes to connect the eastbound and westbound carriageways of the Motorway with roundabouts to be constructed as part of the classified road (the Connecting Roads along these routes being respectively given the reference numbers 1, 2, 3 and 4 on the deposited plan).

GIVEN under the Common Seal of the Council the twentieth day of July 1989.
