The Secretary of State for Transport, in exercise of the powers conferred by sections 97(3), 105 and 108(1)(1) of the Road Traffic Act 1988(2) and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

1.  These Regulations may be cited as the Motor Vehicles (Driving Licences) (Amendment) (No. 6) Regulations 1990 and shall come into force for the purposes of regulation 2 on 1st January 1991 and for all other purposes on 1st April 1991.

2.  Regulations 3(c) and 5(b) of the Motor Vehicles (Driving Licences) (Amendment) Regulations 1990(3) are hereby revoked.

3.  The Motor Vehicles (Driving Licences) Regulations 1987(4) shall be amended–

(a)in regulation 3(1) (interpretation), in the definition of “licence”, by the insertion after the word “Act” of the words “other than a large goods vehicle or passenger-carrying vehicle driver’s licence as defined in section 110(2) of the Road Traffic Act 1988”; and

(b)in regulation 9 (conditions attached to provisional licences), in paragraph (2)(a), by the omission of the words “or a test of competence to drive heavy goods vehicles under Part IV of the 1972 Act”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Motor Vehicles (Driving Licences) (Amendment) Regulations 1990 and the Motor Vehicles (Driving Licences) Regulations 1987.

They defer to 1st April 1991 from 1st January 1991 the coming into force of certain provisions of the 1990 Regulations which would be required on the bringing into force of the provisions of the Road Traffic (Driver Licensing and Information Systems) Act 1989 (c. 22) (provision in sections 1(1) and 2(1) and related repeals) which are now to come into force on 1st April 1991. Those provisions replace the provision for separate licensing of drivers of heavy goods vehicles (Part IV of the Road Traffic Act 1988) and of drivers of public service vehicles (section 22 of the Public Passenger Vehicles Act 1981 (c. 14)) by licences for the drivers of large goods vehicles and passenger-carrying vehicles (as defined in a new Part IV of the Road Traffic Act 1988 in Schedule 2 to the 1989 Act) to be granted as licences under Part III of the 1988 Act.
