The Secretary of State, in exercise of the powers conferred on him by section 249(4) and (9) of the Housing (Scotland) Act 1987(1), and of all other powers enabling him in that behalf, hereby with the consent of the Treasury makes the following Order a draft of which has been laid before and approved by resolution of the House of Commons:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Housing (Grants for Fire Escapes in Houses in Multiple Occupation) (Prescribed Percentage) (Scotland) Order 1990 and shall come into force on the fourteenth day after the day on which it is made.

(2) In this Order–

“the Act” means the Housing (Scotland) Act 1987.

Application

2.  This Order shall apply in relation to any application for a grant for a fire escape under section 249 of the Act duly made on or after the date of coming into force of this Order.

Percentage of Grant

3.  In section 249(4) of the Act there is prescribed in place of the percentage there specified a percentage of 20 per cent.

Explanatory Note

(This note is not part of the Order)

Section 249 of the Housing (Scotland) Act 1987 provides for the making of grants by local authorities for the provision of fire escapes in houses in multiple occupation. The amount of grant is limited to 75 per cent of the maximum amount of expenses incurred in carrying out the work. The maximum amount of expenses can be determined by the local authority up to certain limits.

This Order limits the amount of grant to 20 per cent of the maximum amount of expenses. It does not affect the provision in section 249 which allows a grant of up to 90 per cent in cases of financial hardship. The Order applies only to applications for grant made on or after it comes into force.
