Sections 65(1) and 66(5) of the Electricity Act 1989 provide that, on the transfer date (being a day appointed by the Secretary of State by order under section 65(1) of the 1989 Act), all the property, rights and liabilities of the Electricity Boards in England and Wales and the Electricity Council (subject in the case of the Electricity Council to the exceptions specified in section 66(2) and (6) of the 1989 Act) shall become by virtue of the provision in question property, rights and liabilities of successor companies nominated for the purpose by the Secretary of State.
This Order nominates the companies listed in Schedule 1 as successor companies for the purposes of section 65(1) to the Area Boards; the companies listed in Part 1 of Schedule 2 as successor companies for the purposes of section 66(1) to the Central Electricity Generating Board; and the companies listed in Part II of Schedule 2 as successor companies for the purposes of section 66(2) to the Electricity Council.
