The Sea Fish Industry Authority (Levy Powers) Order 1990

Coming into force in accordance with article 1

The Minister of Agriculture, Fisheries and Food and the Secretaries of State respectively concerned with the sea fish industry in Scotland, Wales and Northern Ireland, in exercise of the powers conferred on them by sections 4(7) and 14(1) of the Fisheries Act 19811 and of all their other enabling powers, hereby make the following Order, of which a draft has been laid before, and approved by resolution of, each House of Parliament:

Title and commencement1

This Order may be cited as the Sea Fish Industry Authority (Levy Powers) Order 1990 and shall come into force on the day after the day on which this Order is made.

Increase in maximum levy rates under section 4 of the Fisheries Act 19812

The rate per kilogram specified in subsections (3)(a) and (4) of section 4 of the Fisheries Act 1981 (levies) is hereby increased from “0.8p” to “2p”.

Section 4 of the Fisheries Act 1981 enables the Sea Fish Industry Authority (“the Authority”) by regulations confirmed by order to impose a levy on persons engaged in the sea fish industry. This Order amends the maximum rate at which the levy may be imposed in respect of the weight of sea fish or sea fish products landed in the United Kingdom or trans-shipped within British fishery limits. The rate is increased from 0.8p per kilogram to 2p per kilogram in the case of sea fish. In relation to any sea fish product the rate must be such that its yield will not in the opinion of the Authority exceed the yield from a levy at the rate of 2p per kilogram (previously 0.8p per kilogram) on the sea fish required on average (whether alone or together with any other substance or article) to produce a kilogram of that product.
