Explanatory Note

(This note is not part of the Regulations)

These Regulations made under sections 218(9)(b)and 232(6) of the Education Reform Act 1988, which apply only in relation to maintained institutions in Walesand to the institutions in Wales designated by Schedule 2, provide for the provision ofcourses, designated by or under Schedule 1 as courses of initial teacher training, to be subject to the approval of the Secretary of State (regulation 4). The Regulations enable the Secretary of State to direct that such a course shall cease to be provided (regulation 5) and to give directions with respect to the number and categories of students to be admitted to a course (regulation 6). TheRegulations succeed provisions contained in the Higher Education (Wales) Regulations 1989 (S.I. 1989/220) which applied to all full-time courses of higher education. The effect of these regulations is, therefore, to remove the requirement for approval in the caseof all courses of higher education other than courses of initial teacher training. This mirrors the position obtaining in England under the Education (Schools and Further and Higher Education) Regulations 1989 (S.I. 1989/351).
