The Housing (Preservation of Right to Buy) (Amendment) Regulations 1989

The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by section 171C of the Housing Act 1985(1) and of all other powers enabling them in that behalf hereby make the following Regulations:

1.  These Regulations may be cited as the Housing (Preservation of Right to Buy) (Amendment) Regulations 1989 and shall come into force on 5th April 1989.

2.  Section 131 of the Housing Act 1985 (limits on amount of discount) as it applies in the circumstances described in section 171A(1) of that Act (cases in which right to buy is preserved) by virtue of the Housing (Preservation of Right to Buy) Regulations 1989(2) is amended by the substitution, in paragraph (c), of the sum of £50,000 for the sum of £35,000, and accordingly a similar substitution is made in paragraph 13 of Part I of Schedule 1 and in Schedule 2 to those Regulations.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend section 131 of the Housing Act 1985 (limits on amount of discount) as applied by the Housing (Preservation of Right to Buy) Regulations 1989 (“the previous Regulations”). These Regulations come into force on 5th April 1989 as do the previous Regulations.

Where the preserved right to buy is exercised by a person in accordance with Part V of the Housing Act 1985 (as modified and adapted by the previous Regulations), the price payable by that person is reduced by an amount of discount calculated in accordance with sections 129 to 131 of and Schedule 4 to that Act (as so modified).

The effect of this amendment is to increase from £35,000 to £50,000 the maximum sum by which the price may be reduced.
