REPRESENTATION OF THE PEOPLE

The European Parliamentary Elections (Welsh Forms) Order 1989

In exercise of the powers conferred upon me by sections 2(1) and 3(4) of the Welsh Language Act 19671, I hereby make the following Order:

This Order may be cited as the European Parliamentary Elections (Welsh Forms) Order 1989 and shall come into force on 21st April 1989.

The European Parliamentary Elections (Welsh Forms) Order 19792 is hereby revoked.

In this Order:

“the 1986 Regulations” means the European Parliamentary Elections Regulations 19863; and
“the 1983 Act” means the Representation of the People Act 19834.

Each of the forms set out in Schedule 1 to this Order is hereby prescribed as the version partly in Welsh and partly in English which shall be used at a European Parliamentary election in Wales, in place of:

a

in the case of form 1, the notice required by rule 29(5) of the parliamentary elections rules in Schedule 1 to the 1983 Act (voting compartment notice)5, as applied by regulation 5 of, and Schedule 1 to, the 1986 Regulations;

b

in the case of forms 2 and 3, forms E and F (official poll card for an elector and for a proxy), respectively, in Schedule 2 to the Representation of the People Regulations 19866, as applied by regulation 5 of, and Schedule 2 to, the 1986 Regulations; and

c

in the case of forms 4, 5 and 6, forms H, J and K (declarations of identity), respectively, in Schedule 2 to the Representation of the People Regulations 1986, as applied by regulation 5 of, and Schedule 2 to, the 1986 Regulations.

Each of the forms set out in Schedule 2 to this Order is hereby prescribed as the Welsh version which may be used at a European Parliamentary election in Wales in place of the forms prescribed by the following provisions in the parliamentary elections rules in Schedule 1 to the 1983 Act, as applied by regulation 5 of, and Schedule 1 to, the 1986 Regulations, which provisions are:

a

in the case of form 1, rule 35(1)(a),

b

in the case of form 2, rule 35(1)(b),

c

in the case of form 3, rule 35(2),

d

in the case of forms 4, 5 and 6, the form of nomination paper, the form of directions for the guidance of the voters in voting7 and the form of declaration to be made by the companion of a blind voter, respectively, set out in the Appendix to those rules.

The forms set out in Schedules 1 and 2 to this Order, except forms 1, 2 and 3 in Schedule 2, may be used with such modifications as circumstances require.

(This note is not part of the Order)

This Order replaces and revokes the European Parliamentary Elections (Welsh Forms) Order 1979 (“the 1979 Order”). The forms prescribed by Schedule 1 to this Order are versions partly in Welsh and partly in English which must be used at a European Parliamentary election in Wales for the purposes referred to in article 4 of this Order. The forms prescribed by Schedule 2 to this Order are Welsh versions of certain forms which may be used at a European Parliamentary election in Wales.

The differences between this Order and the 1979 Order are as follows. The bilingual versions of the official poll cards in Schedule 1 to this Order are based on the revised versions of those cards prescribed by the Representation of the People Regulations 1986, as applied by the European Parliamentary Elections Regulations 1986. In addition Schedule 1 now prescribes a bilingual version of the voting compartment notice and the declarations of identity prescribed by the Representation of the People Regulations 1986.

Schedule 2 to this Order omits the Welsh version of the declaration of secrecy consequent on the repeal of the requirement for such a declaration but includes the Welsh version of the directions for the guidance of the voters in voting.

Mae'r Gorchymyn hwn yn disodli a diddymu'r European Parliamentary Elections (Welsh Forms) Order 1979 (“Gorchymyn 1979”). Mae'r ffurflenni a bennir gan Atodiad 1 y Gorchymyn hwn yn fersiynau rhannol Gymraeg a rhannol Saesneg y mae rhaid eu defnyddio mewn etholiad Senedd Ewrop yng Nghymru at y dibenion y cyfeirir atynt yn erthygl 4 y Gorchymyn hwn. Mae'r ffurflenni a bennir gan Atodiad 2 y Gorchymyn hwn yn fersiynau Cymraeg o rai ffurflenni y gellir eu defnyddio mewn etholiad Senedd Ewrop yng Nghymru.

Mae'r gwahaniaethau rhwng y Gorchymyn hwn a Gorchymyn 1979 fel a ganlyn. Seilir fersiynau dwyieithog y cardiau pleidleisio swyddogol yn Atodiad 1 y Gorchymyn hwn ar y fersiynau diwygiedig o'r cardiau hynny a bennwyd gan Reolau Cynrychiolaeth y Bobl 1986, fel y'u cymhwyswyd gan Reolau Etholiadau Senedd Ewrop 1986. Hefyd, mae Atodiad 1 bellach yn pennu fersiwn dwyieithog o'r rhybudd cabanau pleidleisio a'r datganiadau ynglŷn ag adnabyddiaeth a bennir gan Reolau Cynrychiolaeth y Bobl 1986.

Mae Atodiad 2 y Gorchymyn hwn yn hepgor fersiwn Cymraeg y datganiad cyfrinachedd o ganlyniad i ddiddymu'r gofyniad am ddatganiad o'r fath ond mae'n cynnwys fersiwn Cymraeg o'r cyfarwyddiadau i bleidleiswyr wrth bleidleisio.
