The Secretary of State, being designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the conferment and protection of exclusive rights in the topographies of semiconductor products, in exercise of the powers conferred on him by the said section 2(2) hereby makes the following Regulations:—

1.  These Regulations may be cited as the Design Right (Semiconductor Topographies) (Amendment) Regulations 1989 and shall come into force on 1st December 1989.

2.  The Schedule to the Design Right (Semiconductor Topographies) Regulations 1989(3) shall be amended as follows—

(a)in Part II thereof (which, in relation to the countries named, specifies citizens, subjects, habitual residents, firms and bodies corporate as additional classes of qualifying persons), there shall be included a reference to Sweden; and

(b)in Part III thereof (which, in relation to the countries named, specifies citizens, subjects and habitual residents only as additional classes of qualifying persons), there shall be omitted the reference to Sweden.

Explanatory Note

This note is not part of the Regulations)

These Regulations amend the Schedule to the Design Right (Semiconductor Topographies) Regulations 1989 to give effect to a communication from the European Commission pursuant to paragraph 3 of Article 1 of Council Decision 88/311/EEC (O.J. No. L140, 7.6.1988, page 13). This communication determines that Sweden is a country which satisfies the conditions in paragraph 2 of that Article that protection of topographies of semiconductor products under Swedish law has been extended to all classes of persons in the Member States of the European Economic Community.
