In exercise of the powers conferred by sections 121(1), 126(1) and 232(5) of, and paragraph 4 of Schedule 7 to, the Education Reform Act 1988(1) the Secretary of State for Education and Science, having consulted in accordance with the said paragraph such associations of local authorities as appeared to him to be concerned, hereby makes the following Order:

1.  This Order may be cited as the Education (Higher Education Corporations) (No. 5) Order 1989 and shall come into force on 31st January 1989.

2.  The Southampton Institute of Higher Education is hereby specified as an institution maintained by a local education authority which appears to the Secretary of State to fall within section 121(2) of the Education Reform Act 1988.

3.  In relation to the corporation established under section 121 of the said Act of 1988 by virtue of this Order the transfer date for the purposes of section 126 of that Act shall be 1st April 1989.

4.  The County Council of Hampshire is hereby specified as the local authority entitled to nominate a local authority nominee as an initial nominee member of the said corporation.

Explanatory Note

(This note is not part of the Order)

This Order specifies the Southampton Institute of Higher Education as a local authority maintained institute which appears to the Secretary of State to satisfy the criteria set out in section 121(2) of the Education Reform Act 1988. By virtue of section 121(2), paragraph 1 of Schedule 7 to that Act and the Education Reform Act 1988 (Commencement No. 4) Order 1988 (S.I. 1988/2271) a body corporate by the name of that institution is established on 31st January 1989 for the purpose of conducting that institution as from the transfer date. 1st April 1989 is specified as the transfer date, defined in section 123(2) of the 1988 Act as the date for transfer of local education authority property, rights and liabilities to that corporation. The Order also specifies the County Council of Hampshire as the authority able to nominate a local authority nominee to become a member of the corporation.
