ELECTRICITY

The Electricity Act 1989 (Commencement No.1) Order 1989

The Secretary of State, in exercise of the powers conferred by section 113(2) of the Electricity Act 1989(1) and of all other enabling powers, hereby makes the following Order:–

1.  This Order may be cited as the Electricity Act 1989 (Commencement No.1) Order 1989.

2.—(1) The provisions of the Electricity Act 1989 specified in the first column of Part I of the Schedule to this Order (which relate to the matters specified in the second column of that Schedule) shall come into force on 1st September 1989.

(2) The provisions of that Act specified in the first column of Part II of that Schedule (which likewise relate to the matters specified in the second column of that Schedule) shall come into force on 1st October 1989.

Explanatory Note

(This note is not part of the Order)

This Order brings into force:–

(a)on 1st September 1989, the provisions of sections 1 and 2 of, and Schedules 1 and 2 to, the Electricity Act 1989 (which relate to the Director General of Electricity Supply and consumers' committees) and certain interpretation and supplementary provisions; and

(b)on 1st October 1989, provisions in Part II of the Electricity Act 1989 (which relate to transfers to successor companies, payment for the use of tax losses, Electricity Stock and the abolition of the central guarantee fund), and in Part III of the Act (which relate to the provision of financial assistance for the discharge of nuclear liabilities and to the amendment of the Electricity Supply Pension Scheme and Scottish Pension Schemes) together with certain interpretation provisions, including the definition of “prescribed” in section 64 which is brought into force on 1st October 1989 since this word is used in Schedules 14 and 15.
