Transitional provisions

22.—(1) The following paragraphs of this rule apply where at the date on which these Rules come into force (“the commencement date”) an application or appeal mentioned in rule 3(1) of these Rules is awaiting the Secretary of State’s determination.

(2) Where at the commencement date a local inquiry has been opened but the inspector has not yet reported, the 1974 Rules shall continue to regulate the procedure until immediately before he reports, but these Rules shall apply to the making of the report and thereafter.

(3) Where at the commencement date a local inquiry has not been opened, the 1974 Rules shall continue to apply until the inquiry is opened, but these Rules shall apply thereafter.

(4) The 1974 Rules shall continue to apply as respects hearings but only if the applicant or the local planning authority have before the commencement date expressed a wish to be heard.
