3. Nothing in regulation 2 above shall affect the status as accommodation for residential care of a dwelling which, before the coming into force of the Regulations would have qualified as accommodation for residential care, if it is occupied by a person who, immediately before the coming into force of these Regulations, was licensed by a television licence for accommodation for residential care; and accordingly such a dwelling shall be deemed to be accommodation for residential care for as long as it is occupied by such a person.
