CHANGES IN LOCAL GOVERNMENT AREAS

The Kirkcaldy and Dunfermline Districts (Ballingry) Boundaries Amendment Order 1988

Now, therefore, in exercise of the powers conferred on him by section 17(2) of the said Act, and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order to give effect to the proposals of the Local Government Boundary Commission for Scotland with modifications:

Title and commencement

1.  This Order may be cited as the Kirkcaldy and Dunfermline Districts (Ballingry) Boundaries Amendment Order 1988, and shall come into force on 15th February 1988.

Interpretation

2.  In this Order—

“the 1977 Regulations” means the Local Government Area Changes (Scotland) Regulations 1977((1)); and

“boundary map” means the map prepared by the Scottish Office, marked “The Kirkcaldy and Dunfermline Districts (Ballingry) Boundaries Amendment Order 1988 Map” and deposited in accordance with regulation 3 of the 1977 Regulations; and, in the Schedule to this Order, any reference to a boundary of a region or district is a reference to a boundary existing immediately before the commencement of this Order.

Application of Regulations

3.  Save insofar as they can have no application in relation to the area changes effected by this Order, the provisions of the 1977 Regulations shall apply in relation thereto for the purposes of, or in consequence of, this Order.

Area changes

4.—(1) That part of Dunfermline District described as Area A in Part I of the Schedule to this Order, and shown delineated, hatched and marked “Area A” on the boundary map, shall be transferred to Kirkcaldy District.

(2) That part of Kirkcaldy District described as Area B in Part II of the Schedule to this Order, and shown delineated, hatched and marked “Area B” on the boundary map, shall be transferred to Dunfermline District.

Consequential changes of electoral arrangements

5.—(1) Area A described in Part I of the Schedule to this Order (being the area transferred by article 4(1) of this Order)—

(a)shall cease to form part of electoral division 32 (Ballingry/Lochore) of Fife Region((2)) and of ward 7 (Ballingry) of Dunfermline District((3)); and

(b)shall form part of electoral division 19 (Kinglassie/Cardenden) of Fife Region and of ward 37 (Kinglassie/Bowhill) of Kirkcaldy District((4)).

(2) Area B described in Part II of the Schedule to this Order (being the area transferred by article 4(2) of this Order)—

(a)shall cease to form part of electoral division 19 (Kinglassie/Cardenden) of Fife Region and of ward 37 (Kinglassie/Bowhill) of Kirkcaldy District; and

(b)shall form part of electoral division 32 (Ballingry/Lochore) of Fife Region and of ward 7 (Ballingry) of Dunfermline District.

SCHEDULE

PART I

Area A

The area bounded by a line commencing at a point on the Dunfermline/Kirkcaldy district boundary on the south western perimeter of the B9097 road grid reference NT 1865 9781, thence northwestwards along that perimeter of that road to a point on the Fife/Tayside regional boundary grid reference NT 1855 9795, thence eastwards and southeastwards along that boundary to a point grid reference NT 1876 9793, thence southwestwards along the Dunfermline/Kirkcaldy district boundary to the point of commencement.

PART II

Area B

The area bounded by a line commencing at a point on the Dunfermline/Kirkcaldy district boundary grid reference NT 1857 9776, thence southeastwards, southwestwards and southwards by an unfenced field boundary to a point grid reference NT 1855 9759, thence southwestwards and southeastwards by field boundary to a point NT 1850 9744, thence southwestwards along the northern boundary of a track leading to Capledrae Farm to a point grid reference NT 1842 9739, thence southeastwards across that track to a field boundary, thence southwestwards along that boundary to rejoin the existing Dunfermline/Kirkcaldy district boundary at a point grid reference NT 1821 9717, thence northwestwards and northeastwards along that boundary to the point of commencement.

Explanatory Note

(This note is not part of the Order)

This Order transfers an area of approximately 5.3 acres at Ballingry from Dunfermline District to Kirkcaldy District and an area of approximately 32.40 acres from Kirkcaldy District to Dunfermline District and makes consequential changes to electoral arrangements.

The map annexed to and forming part of this note gives a general guide to the areas affected by this Order as from 15th February 1988.

Copies of the detailed boundary map defined in article 2 to this Order may be inspected at the offices of any of the local authorities referred to in this Order, and may be inspected at or purchased from the Scottish Development Department’s Map Library, New St Andrew’s House, St James' Centre, Edinburgh, EH1 3SZ.

The electoral divisions of Fife Region were constituted by S.I. 1977/1983, to which there are amendments not relevant to this Order.
