LEGAL AID AND ADVICE, ENGLAND AND WALES

The Legal Aid (General) (Amendment) Regulations 1988

The Lord Chancellor, in exercise of the powers conferred on him by sections 9(6), 20 and 25 of the Legal Aid Act 1974(1), hereby makes the following Regulations:—

1.  These Regulations may be cited as the Legal Aid (General) (Amendment) Regulations 1988 and shall come into force on 11th April 1988.

2.  For regulation 96(g) of the Legal Aid (General) Regulations 1980(2), there shall be substituted the following—

(g)supplementary benefit paid under the Supplementary Benefits Act 1976(3), family income supplement paid under the Family Income Supplements Act 1970(4), and income support and family credit paid under the Social Security Act 1986(5); or

(gg)housing benefit paid under the Social Security Act 1986; or.

Explanatory Note

(This note is not part of the Regulations)

These Regulations extend exemption from the statutory charge under section 9(6) of the Legal Aid Act 1974 to income support, family credit and housing benefit paid under the Social Security Act 1986.

1974 c. 4; section 20 was amended by the Legal Aid Act 1979 (c. 26), section 4(2), by the Civil Jurisdiction and Judgments Act 1982 (c. 27), section 40(1) and by the Legal Aid Act 1982 (c. 44), sections 1, 16; section 25 is an interpretation provision and is cited because of the meaning assigned to the word“regulations”.
