PROTECTION OF WRECKS

The Secretary of State for Transport being satisfied in accordance with section 1(4) of the Protection of Wrecks Act 1973(1) that the case is one in which an Order should be made as a matter of immediate urgency, in exercise of the powers conferred upon him by section 1(1) (2) and (4) of that Act and of all other powers enabling him in that behalf, hereby orders as follows:

1.  This Order may be cited as the Protection of Wrecks (Designation No. 2 Order 1984) (Amendment) Order 1988 and shall come into force on 14th December 1988.

2.  The Protection of Wrecks (Designation No. 2) Order 1984(2) shall be amended as follows—

(1) in Article 2(1) for the words “Latitude 50° 39.68' North, Longitude 01° 54.80' West” there shall be substituted the words “Latitude 50° 39.67' North, Longitude 01° 54.79' West ”and

(2) in Article 2(2) for the words “50 metres” there shall be substituted the words “75 metres”.

Explanatory Note

(This note is not part of the Order)

This Order amends the Protection of Wrecks (Designation No. 2) Order 1984 by redefining the centre of the site of an historic wreck in Poole Bay near Poole, Dorset and by increasing the restricted area to one of 75 (instead of 50) metres of site. The amendment is made in order to include in the restricted area an additional part of the wreck recently discovered just outside the one originally designated. No part of the restricted area lies above high water mark of ordinary spring tides.
