Coming into force

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 19801, and now vested in him2, and of all other enabling powers:

The new highways which the Secretary of State proposes to construct—

a

along the route described in Schedule 1 to this Order (the highway along this route being in this Order referred to as “the main new trunk road”);

b

along the routes described in Schedule 2 to this Order (the highways along these routes being in this Order referred to as “the Beckton slip roads”), and

c

along the routes described in Schedule 3 to this Order (the highways along these routes being in this Order referred to as “the Newham Way slip roads”),

shall become trunk roads as from the date when this Order comes into force.

The centre lines of the new trunk roads are indicated by heavy black lines on the deposited plan.

The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunk roads that—

a

where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority; and

b

where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purpose of through traffic.

In this Order:—

All measurements of distance are measured along the route of the relevant highway;

“the deposited plan” means the plan numbered GLRT065/5012/36/ TO1/1—5, marked “The A406 London North Circular Trunk Road (East London River Crossing (A13 to A2) Supplementary Trunk Road and Slip Roads) Order 1988”, signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

“the new trunk roads” means the new trunk roads described in article 1 of this Order; and

iii

“the No. 2 Supplementary Side Roads Order” means “The A406 London North Circular Trunk Road (East London River Crossing (A13 to A2) No. 2 Supplementary Side Roads) Order 1988”.

This Order shall come into force on 11th August 1988 and may be cited as the A406 London North Circular Trunk Road (East London River Crossing (A13 to A2) Supplementary Trunk Road and Slip Roads) Order 1988.

SCHEDULE 1THE MAIN NEW TRUNK ROAD

The route of the main new trunk road is a route, about 2.34 kilometres in length, starting at a point about 239 metres north-west of the north bank of the River Thames at Gallions Reach and extending generally north-westwards and then generally northwards through the Beckton Gas Works to join the South Woodford to Barking Relief Road, all at Beckton in the London Borough of Newham. This route is given the reference number 1 on the deposited plan.

SCHEDULE 2THE BECKTON SLIP ROADS

The routes of these slip roads are the following:—

  • two routes to connect the northbound and southbound carriageways of the main new trunk road with a proposed new highway at Winsor Terrace at Beckton, to be constructed in pursuance of the No. 2 Supplementary Side Roads Order. These routes are respectively given the reference numbers 2 and 3 on the deposited plan.

SCHEDULE 3THE NEWHAM WAY SLIP ROADS

The routes of these slip roads are the following:—

  • two routes to connect the northbound and southbound carriageways of the main new trunk road with the South Woodford to Barking Relief Road and A13 Interchange at Beckton in the London Borough of Newham. These routes are respectively given the reference numbers 4 and 5 on the deposited plan.
