Coming into force

The Secretary of State for Transport makes this Order in exercise of powers conferred by section 10 of the Highways Act 19801, and now vested in him2, and of all other enabling powers:

The lengths of the highways described in the Schedule to this Order and shown by broad striped hatching on the deposited plan shall become trunk roads as from the date on which the Secretary of State notifies the County Council of Warwickshire and the County Council of Hereford and Worcester that the new trunk roads are open for through traffic.

In this Order —

all measurements of distance are measured along the route of the relevant highways;

“the deposited plan” means the plan contained in the folio numbered HA 10/2 WMRO(L)XLIV marked The Evesham — Birmingham Principal Road (A435) (Alcester to Portway) Trunking Order 1987 signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

“the new trunk roads” means the trunk roads to be constructed by the Secretary of State in pursuance of the Bath — Lincoln Trunk Road (Alcester Bypasses A435/A422) Order 19873;

“the A435” means the Evesham — Birmingham Principal Road;

iv

“the B4090” means the Droitwich — Alcester Classified Road.

This Order shall come into force on 21st January 1988 and may be cited as the Evesham — Birmingham Principal Road (A435) (Alcester to Portway) Trunking Order 1987.

SCHEDULE

the 435 from and including its junction with the B4090, generally northwards to the boundary of the Counties of Warwickshire and of Hereford and Worcester at a point approximately 80 meters north-west of the property known as Gorcott Hall, a distance of approximately 10.45 kilometers, and marked “A” on the deposited plan.

the A435 from the boundary of the Counties of Warwickshire and of Hereford and Worcester as described in (1) above, generally northwards to the boundary of the Counties of Hereford and Worcester and of Warwickshire, at a point approximately 150 metres north-west of the property known as High Park Farm, a distance of approximately 3.30 kilometres, and marked “B” on the deposited plan.

the A435 from the boundary of the Counties of Hereford and Worcester and of Warwickshire as described in (2) above, generally northwards to and including its roundabout junction with the M42 motorway at Portway in the County of Warwickshire, a distance of approximately 2.18 kilometres, and marked “C” on the deposited plan.
