The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 19801, and now vested in him2, and of all other enabling powers:

The length of the Trunk Road described in paragraph 1 of the Schedule to this Order and marked A on the deposited plan shall cease to be a trunk road and shall become a classified road as from the date on which the Secretary of State notifies the County Council of Hereford and Worcester that the new trunk roads are open for through traffic.

The length of the Trunk Road described in paragraph 2 of that Schedule and marked B on the deposited plan shall cease to be a trunk road and shall become a classified road as from the date on which the Secretary of State notifies the County Council of Warwickshire that the new trunk roads are open for through traffic.

The length of the Trunk Road described in paragraph 3 of that Schedule and marked C and the deposited plan shall cease to be a trunk road and shall become a principal road as from the date on which the Secretary of State notifies the County Council of Warwickshire that the new trunk roads are open for through traffic.

In this Order:—

All measurements of distance are measured along the route of the relevant highway;

“the deposited plan” means the plan contained in the folio numbered HA 10/2 WMRO(L)XLVII marked“The Bath-Lincoln Trunk Road (A439) (Norton to Stratford-upon-Avon) De-Trunking Order 1987” signed by authority of the Secretary of State are deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

“the new trunk roads” means the trunk roads to be constructed by the Secretary of State in pursuance of the Bath-Lincoln Trunk Road (Alcester Bypasses A435/A422) Order 19873;

“the A435” means the Evesham-Birmingham Principal Road

iv

“principal road” as a classification for a highway means that the highway is a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State; and

v

“classified road” as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;

“the Trunk Road” means the Bath-Lincoln Trunk Road (A439)

This Order shall come into force on 21st January 1988 and may be cited as the Bath-Lincoln Trunk Road (A439) (Norton to Stratford-upon-Avon) De-Trunking Order 1987.

SCHEDULELENGTHS OF THE TRUNK ROAD CEASING TO BE TRUNK ROAD

That length of the Trunk Road in the County of Hereford and Worcester from its junction with the A435 at Norton north-eastwards to the County Boundary for a distance of approximately 2.5 kilometres.

That length of the Trunk Road in the County of Warwickshire from the County Boundary described in the preceding paragraph to the site of the disused level-crossing at Evesham Road, for a distance of approximately 15.2 kilometres.

That length of the Trunk Road in the County of Warwickshire from the site of the disused level-crossing described in the preceding paragraph to its junction with Birmingham Road, Stratford-upon-Avon for a distance of approximately 850 metres.
