The Non-Metropolitan and Welsh Counties (Local Statutory Provisions) Order 1983

The Secretary of State for the Environment in relation to England, and the Secretary of State for Wales in relation to Wales, in exercise of the powers conferred on them by section 262(9)(b) of the Local Government Act 1972 and of all other powers enabling them in that behalf, hereby make the following order:—

1.  This order may be cited as the Non-metropolitan and Welsh Counties (Local Statutory Provisions) Order 1983 and shall come into operation on 21st May 1983.

2.  The date on which all local statutory provisions applying to the whole or any part of a non-metropolitan or Welsh county, so far as they so apply, are to cease to have effect is hereby effect is hereby postponed to 31st December 1986.

EXPLANATORY NOTE

Section 262(9) of the Local Government Act 1972 provides that all local statutory provisions to which that subsection applies shall cease to have effect on specified dates; but allows the date to be postponed in relation to any local authority area by statutory order.

In the case of provisions applying to non-metropolitan counties in England and Welsh counties the specified date is 31st December 1984.

This order postpones that date to 31st December 1986.

The local statutory provisions to which section 262(9) applies are principally Acts promoted by local authorities in force immediately before 1st April 1974 anywhere outside Greater London.
