The Motor Vehicles (Type Approval) (Amendment) Regulations 1982

The Secretary of State for Transport, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972 in relation to the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers conferred on him by the said section 2(2) and of all other enabling powers, hereby makes the following Regulations:—

1.  These Regulations may be cited as the Motor Vehicles (Type Approval)(Amendment) Regulations 1982 and shall come into operation on 5th February 1982.

2.  The Motor Vehicles (Type Approval) Regulations 1980 shall have effect in accordance with the following provisions of these Regulations.

3.  In Schedule 1, in Part I (Form of information document in relation to a motor vehicle)—

(a)at the head of the list of items for the words “Notes (a) to (p) are at the end of this Part of this Schedule.” substitute the words “Notes (a) to (r) are at the end of this Part of this Schedule.”;

(b)for items 3.8. and 3.9. substitute the following new items:—

3.8.  Max net power, kw @ rpm (q)

  

3.9.  Max net torque, Nm @ rpm (r);

(c)after item 3.24.2. insert the following new items:—

3.25.FUEL CONSUMPTION
3.25.1.Urban cycle l/100 km
3.25.2.Constant speed @ 90 km/h l/100 km
3.25.3.Constant speed @ 120 km/h l/100 km;

and

(d)after Note (p) add the following Notes:—

(q)Determined in accordance with the requirements of Directive 80/1268/EEC of 16.12.80.

; and

(r)Determined in accordance with the requirements of Directive 80/1269/EEC of 16.12.80..

4.  In Schedule 2, in Part I (The Community Directives relating to the design, construction, equipment and marking of vehicles or vehicle components):—

(a)in item 1, add—

(i)in column 2(a), “or 70/157/EEC as amended by 73/350/EEC and by 77/212/EEC and by 81/334/EEC”;

(ii)in column 2(b), “13 April 1981”; and

(iii)in column 2(c), “O.J. L131, 18.5.1981, p.6”;

(b)in item 3, add—

(i)in column 2(a), “or 70/221/EEC as amended by 79/490/EEC and by 81/333/EEC”;

(ii)in column 2(b), “13 April 1981”; and

(iii)in column 2(c), “O.J. L131, 18.5.1981, p.4”; and

(c)after item 38, add the following new items:—

3980/1268/EEC16 December 1980O.J. L375, 31.12.1980, p.36Fuel consumption of motor vehicles
4080/1269/EEC16 December 1980O.J. L375, 31.12.1980, p.46Engine power of motor vehicles.

EXPLANATORY NOTE

These Regulations amend the Motor Vehicles (Type Approval) Regulations 1980—

(a) by amending, and adding to, in consequence of Council Directive 80/1267/EEC, items listed in the prescribed form of information document relating to a motor vehicle (see Regulation 3);

(b) by amending, in consequence respectively of Commission Directives 81/334/EEC and 81/333/EEC, the items relating to the permissible sound level and exhaust system of motor vehicles and liquid fuel tanks and rear underrun protection for motor vehicles and their trailers; and

(c) by adding, in consequence of Council Directives 80/1268/EEC and 80/1269/EEC new items relating, respectively, to fuel consumption of motor vehicles and engine power of motor vehicles in the list of items which comprise “the type approval requirements” as defined in Regulation 3(1) (see Regulation 4).

2. Copies of the EEC Directives referred to in these Regulations may be obtained from Her Majesty's Stationery Office.
