SOCIAL SECURITY

The Social Security Act 1980 (Commencement No. 1) Order 1980

The Secretary of State for Social Services, in exercise of the powers conferred on him by section 21(5) of the Social Security Act 1980, and of all other powers enabling him in that behalf, hereby makes the following order:—

Citation

1.  This order may be cited as the Social Security Act 1980 (Commencement No.1) Order 1980.

Appointed days

2.—(1) The day appointed for the coming into force of each provision of the Social Security Act 1980 which is specified in column (1) of Schedule 1 to this order shall be the date specified in column (3) of that Schedule in relation to that provision.

(2) Subject to the provisions of Article 3 of this order, the day appointed for the coming into force of those provisions of the Social Security Act 1980 which are specified in the Schedule 2 to this order shall be 24th November 1980.

Transitional provisions and savings

3.  Until (but not including) the day on which the first regulations made after 24th November 1980 under section 22(5) of the National Assistance Act 1948 come into operation—

(a)that part of paragraph 2(1) of Schedule 4 to the Social Security Act 1980 which amends section 22(5) of the National Assistance Act 1948 shall operate only for the purpose of enabling the Secretary of State to make such regulations; and

(b)paragraph 30 of Schedule 2 to the Social Security Act 1980, and so far as it relates thereto section 6(1) of that Act, shall operate subject to the saving that Part III of Schedule 1 to the Supplementary Benefits Act 1976 shall remain in force for the purpose only of section 22(5) of the National Assistance Act 1948, and section 6(3) of the Social Security Act 1980 shall be construed accordingly.

EXPLANATORY NOTE

This order brings into force, on specified days in 1980, all those provisions of the Social Security Act 1980 which did not come into force on the passing of the Act, with the exception of those relating to similar treatment for men and women and those relating to supplementary schemes for industrial injuries and diseases.
