The Plant Varieties and Seeds Act 1964 (Repeals) (Appointed Day) Order 1978

1st September 1978

The Minister of Agriculture, Fisheries and Food and the Secretaries of State, acting jointly, in exercise of the powers conferred on them by Section 4 of and Part III of Schedule 3 to the European Communities Act 1972, and of all other powers enabling them in that behalf, hereby make the following order:—

1.—(1) This order may be cited as the Plant Varieties and Seeds Act 1964 (Repeals) (Appointed Day) Order 1978.

(2) The Interpretation Act 1889 shall apply to the interpretation of this order as it applies to the interpretation of an Act of Parliament.

2.—(1) The repeal of Section 32 of the Plant Varieties and Seeds Act 1964 (which enables the Minister of Agriculture, Fisheries and Food and the Secretaries of State to make orders for the purpose of preventing the importation into the United Kingdom of certain kinds of seeds) shall take effect on 1st September 1978.

(2) The repeal of Section 2(4)(a) of the Trade Descriptions Act 1968, (which provides that descriptions or marks applied in pursuance of the Seeds Act 1920 shall be deemed not to be trade descriptions) shall take effect on 1st September 1978.

EXPLANATORY NOTE

This Order appoints a day for the repeal of certain provisions of the Plant Varieties and Seeds Act 1964 and the Trade Descriptions Act 1968 which are not compatible with the United Kingdom's obligations to the European Economic Communities.
