The Fishing Vessels (Safety Provisions) (Amendment No. 2) Rules 1977

The Secretary of State, after consulting with the organisations referred to in section 7(2) of the Fishing Vessels (Safety Provisions) Act 1970 in exercise of powers conferred by section 427 of the Merchant Shipping Act 1894 as substituted by section 2 of the Merchant Shipping (Safety Convention) Act 1949 and amended by section 9 of the Merchant Shipping Act 1964 and now vested in him(1), and of all other powers enabling him in that behalf, hereby makes the following Rules:—

1.  These Rules may be cited as the Fishing Vessels (Safety Provisions) (Amendment No. 2) Rules 1977 and shall come into operation on 15th April 1977.

2.  The Fishing Vessels (Safety Provisions) Rules 1975(2), as amended(3), shall be further amended as follows:—

After paragraph (r) of Part I of Schedule 9, there shall be added the following paragraph:—

(s)Notwithstanding the provisions of the foregoing paragraphs of this Part of this Schedule, any liferaft the inflatable chambers or floor of which are made of rubber-proofed cotton—

(i)made on or before 31st December 1965, shall be treated as not complying with the requirements of this Part of this Schedule on or after 1st July 1978;

(ii)made on or after 1st January 1966, shall be treated as not complying with the requirements of this Part of this Schedule on or after 1st July 1979.

EXPLANATORY NOTE

These Rules further amend the Fishing Vessels (Safety Provisions) Rules 1975 by providing for the phasing out, in two stages, of liferafts the inflatable chambers or floors of which are made of rubber-proofed cotton, so that by 1st July 1979 all liferafts of that type shall cease to comply with the requirements of those Rules.
