Coming into Operation

The Secretary of State for the Environment, in exercise of the powers conferred upon him by paragraph 14 of Schedule 2 to the Local Government Act 1972 and of all other powers enabling him in that behalf, hereby makes the following order:—

This order may be cited as the Local Government Act 1972 (References to Aldermen) Order 1977 and shall come into operation on 8th May 1978.

The Interpretation Act 1889 shall apply for the interpretation of this order as it applies for the interpretation of an Act of Parliament.

In the Local Government Act 1972—

a

for section 67(5)(c) there shall be substituted—

c

the total number of councillors, the apportionment of councillors among electoral areas, the assignment of existing councillors to new or altered electoral areas and the first election of councillors for any new or altered electoral area;

b

in section 81(3)(a), for “, deputy chairman or an alderman” there shall be substituted “or deputy chairman”;

c

the following, namely—

  • in section 83(1), “, alderman or”; section 87(1)(g);

  • in section 88(1), “or of any alderman”; section 173(5); and

  • in Schedule 12, Part I, paragraph 5(2), “or an alderman”

shall be omitted.

EXPLANATORY NOTE

This Order amends provisions of the Local Government Act 1972 to remove references to aldermen.
