The Pensions Commutation (Amendment) Regulations 1977

The Minister for the Civil Service, in exercise of the powers conferred by sections 4 and 7 of the Pensions Commutation Act 1871 and section 3 of the Pensions Commutation Act 1882, and now vested in him(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:—

1.  These Regulations may be cited as the Pensions Commutation (Amendment) Regulations 1977, and shall come into operation on 10th February 1977.

2.  The Interpretation Act 1889 shall apply for the interpretation of these Regulations as it applies for the interpretation of an Act of Parliament.

3.  The Pensions Commutation Regulations 1968, as amended(2), shall be further amended by substituting for Regulation (1) thereof, the following Regulation:—

9.(1) There shall be charged in respect of the commutation of any pension or any portion of a pension a fee of 1½ per cent. on the amount awarded;

provided that such fee shall not be less than £10 or more than £75 in any case..

EXPLANATORY NOTE

These Regulations increase the fee chargeable under the Pensions Commutation Regulations 1968 for the commutation of a pension or portion of a pension.
