Coming into Operation

The Secretary of State in exercise of the powers conferred on him by section 15(1) and (3)(a) of the Health and Safety at Work etc. Act 1974 and of all other powers enabling him in that behalf and for the purpose of giving effect without modifications to proposals submitted to him by the Health and Safety Commission under section 11(2)(d) of the said Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of the said Act, hereby makes the following Regulations:—

Citation, commencement and interpretation1

These Regulations may be cited as the Offices, Shops and Railway Premises Act 1963 (Repeals) Regulations 1975 and shall come into operation on 28th July 1975.

The Interpretation Act 1889 shall apply to the interpretation of these Regulations as it applies to the interpretation of an Act of Parliament.

Repeals etc2

In the Offices, Shops and Railway Premises Act 1963—

a

the provisions mentioned in column 1 of the Schedule to these Regulations are hereby repealed to the extent specified in column 2 of that Schedule; and

b

in section 83(1), for the reference to section 21 there shall be substituted a reference to section 19.

EXPLANATORY NOTE

These Regulations repeal the following provisions of the Offices, Shops and Railway Premises Act 1963, namely, section 27 (penalisation of dangerous acts and interference with equipment), section 47 (prohibition of levying of charges on employees for things done in compliance with the Act), section 51 (power to adapt Act in relation to covered markets), section 60(1), so far as it relates to annual reports by local authorities, and section 79 (Minister's annual report), which have been superseded by provisions of the Health and Safety at Work, etc. Act 1974. The Regulations also make minor drafting changes consequential on earlier repeals in sections 83(1) and 42(5) of the 1963 Act.
