The Explosives Acts 1875 and 1923 Etc. (Repeals and Modifications) (Amendment) Regulations 1974

The Secretary of State in exercise of the powers conferred on him by sections 15(1) and (3)(a) of the Health and Safety at Work etc. Act 1974 and of all other powers enabling him in that behalf, and after consultation with the Health and Safety Commission and such other bodies as appeared to him to be appropriate, hereby makes the following Regulations:—

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Explosives Acts 1875 and 1923 etc. (Repeals and Modifications) (Amendment) Regulations 1974 and shall come into operation on 1st January 1975.

(2) The Interpretation Act 1889 shall apply to the interpretation of these Regulations as it applies to the interpretation of an Act of Parliament.

Amendment

2.  In the Explosives Acts 1875 and 1923 etc. (Repeals and Modifications) Regulations 1974(1), in Schedule 1 (which sets out in column 1 the provisions of the Explosives Act 1875 repealed by those Regulations and in column 2 the extent to which those provisions are repealed), for the entries relating to sections 73, 75 and 89 of that Act there shall be substituted respectively the following entries:—

   

In column 1 In column 2
“Section 73.The whole section except in so far as it relates to the powers of a constable.
Section 75.The whole section except in so far as it relates to the powers of officers of police.
Section 89.The whole section except for the purposes of sections 30, 32 and 73.

EXPLANATORY NOTE

These Regulations amend the Explosives Acts 1875 and 1923 etc. (Repeals and Modifications) Regulations 1974 so that sections 73, 75 and 89 of the Explosives Act 1875 (which relate to powers of search for and seizure and forfeiture of explosives and which were to be repealed by these Regulations on 1st January 1975) will remain in force in so far as they enable the police to exercise those powers.
