The Secretary of State for the Home Department, in exercise of his powers under sections 1(1) and (2) and 4(1) and (3)(a) of the Pensions (Increase) Act 1974, with the consent of the Minister for the Civil Service, hereby makes the following Regulations:—

1.  These Regulations may be cited as the Pensions Increase (Coroners) Regulations 1974.

2.  These Regulations shall come into operation on 6th November 1974 and shall have effect from 1st December 1973.

3.—(1) In these Regulations “the Act of 1974” means the Pensions (Increase) Act 1974.

(2) The Interpretation Act 1889 shall apply for the interpretation of these Regulations as it applies for the interpretation of an Act of Parliament.

4.  Pensions payable under section 6 of the Coroners (Amendment) Act 1926 (which relates to the superannuation of coroners) are hereby prescribed for the purposes of section 1(1) of the Act of 1974.

5.  The date on which, in the opinion of the Secretary of State, the emoluments relevant for the purpose of calculating a pension prescribed by these Regulations were increased by the principal pay increase made or to be made during the year ending with 6th November 1974 in accordance with the code in force under section 2 of the Counter-Inflation Act 1973 at the time of the increase is—

(a)in the case of a pension payable to a part-time coroner, 7th November 1973;

(b)in the case of a pension payable to a full-time coroner by the county council of West Yorkshire, 1st April 1974;

(c)in the case of a pension payable to a full-time coroner by the Greater London Council, 26th July 1974;

(d)in the case of a pension payable to a full-time coroner by the county council of Merseyside, 1st August 1974;

(e)in the case of a pension payable to any other full-time coroner, 1st July 1974.

6.  Any increase of pension payable by virtue of these Regulations shall have effect in respect of any period beginning on or after 1st December 1973.

EXPLANATORY NOTE

These Regulations make provision in relation to pensions of coroners whereby the basic rate of certain of those pensions may be increased under the Pensions (Increase) Act 1974.

The Regulations have effect from 1st December 1973 by virtue of provision made under section 4(3)(a) of the Act.
