The Increase of Pensions (Police and Fire Services) (Amendment) (No. 2) Regulations 1973

Coming into Operation

In exercise of the powers conferred on me by section 5(3) and (4) of the Pensions (Increase) Act 1971, I hereby, with the consent of the Minister for the Civil Service, make the following Regulations:—

These Regulations may be cited as the Increase of Pensions (Police and Fire Services) (Amendment) (No. 2) Regulations 1973.

These Regulations shall come into operation on 1st July 1973 and shall have effect as from 1st April 1972.

For paragraph (1) of Regulation 4 of the Increase of Pensions (Police and Fire Services) Regulations 19711, as amended2, (pensions reduced on account of additional benefit), there shall be substituted the following provision:—

This Regulation shall apply to a pension payable to or in respect of a person who retired, or ceased to serve, before 1st April 1972, being a pension payable in accordance with—

a

the Police Pensions Regulations;

b

the Special Constables (Pensions) Regulations;

c

the Police Cadets (Pensions) Regulations, or

d

the Firemen's Pension Scheme,

which is reduced in amount or is not payable on account of the payment of some additional benefit.

EXPLANATORY NOTE

These Regulations amend the Increase of Pensions (Police and Fire Services) Regulations 1971 and have effect as from 1st April 1972, the date from which certain changes take effect in the provisions governing fire service pensions (retrospective effect is authorised by section 5(4) of the Pensions (Increase) Act 1971.

Pensions payable to firemen with service on or after 1st April 1972 are excluded from the operation of Regulation 4 of the Regulations of 1971.
