The Health Service (Northern Ireland Agreement) Order 1971

Whereas by section 67(3) of the Finance Act 1971 it is provided that section 67(1) and (2) of that Act (which confirm the Health Service Agreement between the Treasury and the Ministry of Finance for Northern Ireland set out in Schedule 13 to that Act) shall not come into operation unless and until Her Majesty by Order in Council declares that a corresponding provision has been enacted by the Parliament of Northern Ireland:

And Whereas the Parliament of Northern Ireland has passed the Finance Act (Northern Ireland) 1971, and Her Majesty is satisfied that section 8 of that Act is such corresponding provision as aforesaid:

Now, therefore, Her Majesty, in pursuance of section 67(3) of the Finance Act 1971 , is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

This Order may be cited as the Health Service (Northern Ireland Agreement) Order 1971.

The Interpretation Act 1889 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

It is hereby declared that a provision corresponding to section 67(1) and (2) of the Finance Act 1971 has been enacted by the Parliament of Northern Ireland.

EXPLANATORY NOTE

The Treasury and the Ministry of Finance for Northern Ireland have entered into an Agreement dated 14th April 1971 (set out in Schedule 13 to the Finance Act 1971 ) with a view to assimilating the burdens on the Consolidated Fund of the United Kingdom and the Exchequer of Northern Ireland in respect of health services. Confirmation of the Agreement of 14th April 1971 is given by section 67(1) of the Finance Act 1971, but the provisions of section 67(1) and (2) of that Act are not to come into operation unless and until Her Majesty by Order in Council declares that a corresponding provision has been enacted by the Parliament of Northern Ireland. This Order declares that a corresponding provision has been so enacted.
