An Act to amend the Law relating to Commons.
[22nd September 1893]
This Act may be cited for all purposes as the Law of Commons Amendment Act 1893.
M1M2An inclosure or approvement of any part of a common purporting to be made under the statute of Merton and the statute of Westminster the second, or either of such statutes, shall not be valid unless it is made with the consent of the [F1Secretary of State.]

In giving or withholding [F2his consent] under this Act, the [F2Secretary of State] shall have regard to the same considerations, and shall, if necessary, hold the same inquiries as are directed by the M3Commons Act 1876 to be taken into consideration and held by the [F2Secretary of State] before forming an opinion whether an application under the Inclosure Acts shall be acceded to or not.

Nothing in this Act shall preclude Her Majesty Her heirs and successors, or any person whatsoever whose rights or interests are affected by any inclosure or approvement, from taking any proceedings by way of information, action, or otherwise, for the abatement of such inclosure or approvement and the protection of such rights and interests.
