17U.K.No Miner or other Person shall, except as herein-after mentioned, bring more than One Action of Title to recover the same Mine, and a Nonsuit shall be deemed of the same Effect as a Judgment for the Defendant; but in Actions of Trespass or Debt the Plaintiff, if nonsuited, shall be allowed to commence a fresh Action: Provided always, that the Steward shall in any Case whatever, whether of Title, Trespass, or Debt, have the Power, if he shall think fit, to order a new Trial to be had, upon such Terms as he shall think reasonable, and in the meantime to stay the Proceedings.
