Duchy of Lancaster Act 1812

  1. Introductory Text

  2. II.For removing Doubts in the Form of Conveyances, in Cafes of Exchanges of Land within the ordering and Survey thereof.

  3. III.His Majesty may demise Lands for Gardens, &c.

  4. IV.Treasury may authorize the Commissioners of Woods, &c. to contract for exchanging Lands.

  5. V.Treasury to alienate small Parcels of Land intermixed with Lands of Individuals.

  6. VI.Land to be exchanged or sold, to be surveyed by practical Surveyors.

  7. VII.Treasury empowered to authorize the making of Railways, &c. to Quarries, &c. in the Forests; and Commissioners of Woods &c. or Surveyor General of Woods, &c. to grant Leases for that Purpose.

  8. VIII.Treasury or the Surveyor General, may make Compensations, or grant Leases to Persons relinquishing Parts of Forest.

  9. IX.Where Encroachments have been made on the Skirts of the Forests, or in Parts not suited for the Growth of Timber, the Commissioners of Woods, &c. or the Surveyor General empowered to grant Leases thereof.

  10. X.Instrument to be enrolled in the Office of the Auditor of the Land Revenue.

  11. XI.Unlawful Enclosures, &c. to be enquired of by the Verderers, &c.

  12. XII.The Verderers may appoint Officers for executing the Orders of the Court.

  13. XIII.Regarded, Foresters, and other Officer, shall before the holding of Courts of Attachments survey the Forests, and take an Account of Enclosures, &c.

  14. XIV.Court of Attachments may enquire into the Conduct of the Regarders and other Officers, and for Neglect of Duty may fine them.

  15. XV.And be it further enacted, That all pecuniary Penalties impeded,...

  16. XVI.Act not to infringe any Rights under Letters Patent.

  17. XVII.Not to prevent proceeding by ordinary Course of Law if thought more adviseable.

  18. XVIII.Rent of Lands to be paid to Commissioners or Surveyor General, and to be applicable as other Funds under their Management.

  19. XIX.Map or Plan to be completed in Five Years.

  20. XX.Surveyor of Roads, &c. not to dig for Gravel, &c. in Woods belonging to the Crown.

  21. XXI.Commissioners not to fell or grant in exchange any Marle Pits, Peat Lands, or Gravel Pits.

  22. XXII.No Exchanges or Sales to be made which shall interrupt the Access to the Forests from adjoining Estates.

  23. XXIII.Commissioners of Woods, &c. to receive Verifications and take Examinations on Oath touching Matters which relate to the Department of the Land Revenue.

  24. XXIV.Two of the Commissioners of Woods, &c. may act.

  25. XXV.Money arising by the Acts herein recited to be laid out in the Purchase of Lands fit for the Growth of Timber.

  26. XXVI.After the Completion of Purchase under the recited Act of 36 G.3 the Lands shall become Part of the Manor of King's Cliffe.

  27. XXVII.His Majesty may grant Land for Curtilages and Accedes to Churches or Chapels.
