8 Penalties and legal proceedings.E+W+S
(1)[F1Any person guilty of an offence under this Act shall be liable on summary conviction to a fine not exceeding level 4 on the standard scale F2. . .; and] the court by whom any person is convicted of an offence under this Act may order to be forfeited any fish, eggs of fish, foodstuff or article in respect of which the offence was committed.
[F3(2)In England and Wales a water authority shall have power to take legal proceedings to enforce provisions of this Act as respects [F4inland waters] . . . F5.
(3)Offences against this Act committed in [F4inland waters] in Scotland (including offences committed in [F6inland waters in Scotland] with respect to which functions under this Act are exercisable by the [F7Environment Agency]) shall be [F8proceeded against and punished in Scotland].]
[F9(4)For the purposes of and incidental to the jurisdiction of any magistrates’ court or, in Scotland, of the sheriff, any offence under this Act committed in the territorial sea adjacent to Great Britain shall be taken to have been committed in any place in which the offender may for the time being be found.]
