Section 352 (meaning of “qualifying oil field”) is amended as follows.

After subsection (1) insert—

An oil field is an “onshore field” for the purposes of subsection (1) if—
a
the authorisation day is on or after 5 December 2013, and
b
on the authorisation day every part of the oil field is, or is part of, an onshore licensed area;
but see the transitional provisions in paragraph 7 of Schedule 15 to FA 2014.

A licensed area is an “onshore licensed area” if it falls within the definition of “landward area” in the regulations pursuant to which the application for the licence was made.
