51 E+W+S The Transport and Works Act 1992 is amended as follows.

Commencement Information

I1 Sch. 2 para. 51 in force at 1.3.2010 by S.I. 2010/101, art. 2 (with art. 6)

52 E+W+S In section 1 (orders as to railways, tramways etc.) after subsection (1) insert—

“(1A) Subsection (1) is subject to—

(a) section 33(2) of the Planning Act 2008 (exclusion of powers to authorise development);

(b) section 120(9) of that Act (exclusion of power to include ancillary provision in orders).”

53 E+W+S In section 3 (orders as to inland waterways etc.) after subsection (1) insert—

“(1A) Subsection (1) is subject to—

(a) section 33(2) of the Planning Act 2008 (exclusion of powers to authorise development);

(b) section 120(9) of that Act (exclusion of power to include ancillary provision in orders).”
