163Orders and regulations: control by National Assembly for Wales

Subject to subsection (2), a statutory instrument containing—
a
regulations made under this Act by the Welsh Ministers, or
b
an order under section 167(2) (transitional provision etc.) made by the Welsh Ministers,
is subject to annulment in pursuance of a resolution of the National Assembly for Wales.

Subsection (1) does not apply to a statutory instrument to which subsection (3) applies.

The Welsh Ministers may not make a statutory instrument containing (whether alone or with other provision)—
a
the first regulations made by the Welsh Ministers under section 120 (additional responsibilities of responsible officers), F1...

unless a draft of the instrument has been laid before, and approved by a resolution of, the National Assembly for Wales.
