Communications Act 2003

An Act to confer functions on the Office of Communications; to make provision about the regulation of the provision of electronic communications networks and services and of the use of the electro-magnetic spectrum; to make provision about the regulation of broadcasting and of the provision of television and radio services; to make provision about mergers involving newspaper and other media enterprises and, in that connection, to amend the Enterprise Act 2002; and for connected purposes.

Section 66 of the 1990 Act (requirements relating to transmission and distribution of services) shall be amended as follows.

For “the Commission”, wherever occurring, there shall be substituted “ OFCOM ”.

In subsections (1) and (2), for “for general reception” there shall be substituted “ so as to be available for reception by members of the public ”.

After subsection (2) there shall be inserted—

In subsections (1) and (2) “available for reception by members of the public” shall be construed in accordance with section 361 of the Communications Act 2003
