Communications Act 2003

An Act to confer functions on the Office of Communications; to make provision about the regulation of the provision of electronic communications networks and services and of the use of the electro-magnetic spectrum; to make provision about the regulation of broadcasting and of the provision of television and radio services; to make provision about mergers involving newspaper and other media enterprises and, in that connection, to amend the Enterprise Act 2002; and for connected purposes.

Part 1Amendments of the 1990 Act

General licence conditions

Section 4 of the 1990 Act (general licence conditions) shall be amended as follows.

For “the Commission”, wherever occurring, there shall be substituted “ OFCOM ”.

In subsection (1), in each of paragraphs (a) and (c), after “this Act” there shall be inserted “ , the Broadcasting Act 1996 or the Communications Act 2003 ”.

In subsection (3) (fixing of fees), the words from “and the amount” onwards shall be omitted.

In subsection (5) (provision of false information to be breach of condition)—

a

for “imposed under this Part” there shall be substituted “ contained in the licence ”; and

b

after “and 42” there shall be inserted “ or (as the case may be) sections 237 and 238 of the Communications Act 2003 (enforcement of television licensable content service licences) ”.
